Fragrance Regulation

IFRA UK ensures members are kept apprised of the regulatory environment in which they operate.
Members’ views and feedback on legislative proposals are fed into the industry response to any consultations as well as proactive liaison with governmental departments and stakeholder associations along the supply chain.

Our aim is always to have workable and enforceable legislation which enables the industry to remain globally competitive whilst maintaining consumer safety and choice.

Examples of sector-specific legislation which affects the UK industry, current as of August 2020:

The European Regulation (EC) No 1272/2008  on classification, labelling and packaging of substances and mixtures – the CLP Regulation – came into force in all EU member states, including the UK, on 20 January 2010. 

REACH  is a European Union Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and restriction of Chemicals. It came into force on 1st June 2007

Regulation (EC) N° 1223/2009, as amended, on cosmetic products is the main regulatory framework for finished cosmetic products when placed on the EU market.

(EU) Regulation 648/2004 on Detergents covers the conditions for placing detergents on the market.

Other legislation affecting the fragrance industry includes legislation surrounding Intellectual Property, Occupational Health & Safety and the Environment.

Due to the global nature of the fragrance industry, IFRA UK believes it is important to monitor worldwide legislative developments in order to ensure consistency. It is important that local legislation does not put the UK fragrance industry at a competitive disadvantage, which results in barriers to trade.

 

BREXIT

The legislation listed above is European legislation which the UK is still subject to during the transition period.
From 1st January 2021, the UK will incorporate EU legislation (as of 31st December 2020) into the UK as retained law, with minor adjustments to achieve workability in the UK.

 Members are kept fully informed of developing changes to legislation.

Adherence to EU legislation will still be required for supply of products to the EU, as with any local legislation.
